The new war in the Middle East – an Iranian perspective on the legal framework

On June 13th, Israeli military forces launched a direct and unprovoked attack on the territory of the Islamic Republic of Iran. This act constitutes not only a blatant violation of the fundamental principles and norms of international law but also precipitates profound strategic ramifications within the broader Middle Eastern and global contexts. The incident unfolds against a backdrop of persistent political, economic, and security challenges that have rendered the region increasingly fragile and unstable.

International law, particularly the Charter of the United Nations, enshrines the sovereignty and territorial integrity of states as pillars of the global order and explicitly prohibits the threat or use of force against the political independence or territorial integrity of any state. Regardless of the motivations or objectives that may underlie Israel’s actions, this operation flagrantly contravenes these principles and is bound to engender adverse long-term consequences for regional and international stability.

This study aims to analyze the issue from a legal framework while exploring its strategic and political implications, particularly for Iran, its neighboring states, and the European Union.

Article 2(4) of the UN Charter mandates that all member states refrain from the threat or use of force against the territorial integrity or political independence of any state. Accordingly, no state may lawfully engage in military aggression against another unless authorized by the UN Security Council or exercising the inherent right of self-defense as stipulated in Article 51.

Currently, no credible evidence exists indicating that Iran has conducted an armed attack against Israel that could legitimize such a military response. Therefore, Israel’s direct military operation constitutes a clear breach of international law. This action violates Iran’s sovereignty and undermines the international legal order, thereby carrying serious and negative repercussions. Israel has previously engaged in covert and targeted operations within the territories of regional states. However, a direct strike on Iranian soil represents an escalation of unprecedented magnitude. Such acts fall within the scope of military aggression under international law, subject to stringent legal and political sanctions.

Iran, under the purview of international legal norms, retains the right to seek redress through appropriate international channels. Institutions such as the UN Security Council, the International Court of Justice, and other legal bodies provide avenues for both legal recourse and political advocacy. Collectively, these factors demonstrate that Israel’s action poses a fundamental threat to international order and peace, demanding a resolute and coordinated response from the global community. Israel’s military attack on Iran yields extensive and multifaceted consequences at both regional and international levels. The Middle East, which has already grappled with numerous crises, is now entering a phase of heightened instability and insecurity.

 Security and Military Consequences

Iran, despite facing sanctions and international pressures, possesses substantial military capabilities that enable it to mount a strong and comprehensive response. This may manifest through support for regional resistance groups, heightened tensions along Iran’s borders with neighboring countries, and retaliatory operations against Israeli interests and allies. Such developments risk igniting a cycle of violence and proxy conflicts, further destabilizing the security landscape of the entire region. Neighboring states, given their geographic proximity and political-economic ties with Tehran, will also confront significant security threats. They might endure spillover effects of conflicts or be compelled to adopt complex strategic stances that exacerbate regional tensions.

Economic and Energy Impacts

As a critical hub for global oil and gas production and exports, the Middle East’s stability is vital for international energy markets. Escalation of conflicts in the region typically results in disruptions to energy supplies and spikes in prices. Europe, which has endeavored to diversify its energy sources and reduce dependency on unstable supplies, faces the risks of sudden price surges and potential interruptions. These dynamics pose serious economic challenges for European countries, including increased energy costs, inflationary pressures, and operational difficulties in key industries reliant on energy. Additionally, heightened regional insecurity tends to deter foreign investments, thereby slowing economic recovery efforts.

Political and Diplomatic Repercussions

The attack and subsequent international responses present a complex challenge for regional and global diplomacy. The European Union and other international actors must adopt approaches grounded in respect for international law. Any double standards or implicit support for Israeli aggression would undermine the credibility of these actors and foster distrust both regionally and globally. Europeans, balancing their security and economic interests, should strive to play an active and constructive role in conflict de-escalation. This includes facilitating regional dialogue, supporting multilateral security and legal mechanisms, and refraining from direct military interventions. In the face of this blatant aggression, the Islamic Republic of Iran is expected to pursue a broad spectrum of responses encompassing military, legal, and diplomatic avenues. Leveraging its domestic capacities and regional partnerships, Iran can formulate a comprehensive strategy to mitigate the consequences of the attack.

Strengthening Defense and Deterrence Capabilities

In recent years, Iran has invested heavily in defense technologies, including missile systems, drones, and cyber capabilities, which have enhanced its deterrence posture. These capabilities are pivotal in preventing further Israeli military incursions and enabling effective retaliation. Moreover, deepening military cooperation with neighboring states and regional resistance groups can bolster national security.

Utilizing Legal and Diplomatic Channels

Iran should actively engage with international bodies such as the United Nations, the Security Council, and international courts to expose Israel’s aggression and garner global support. A proactive, evidence-based diplomatic campaign can exert political and legal pressure on Israel.

Impact on Relations with the European Union

The EU’s stance in this crisis will be decisive. Given its economic and security interests in the region, Europe has the potential to facilitate de-escalation and uphold international legal norms. A principled and transparent approach will not only enhance Europe’s credibility but also pave the way for broader cooperation. Conversely, adopting ambiguous or partial positions that tacitly endorse Israeli aggression would damage EU-Iran relations and constrain future collaboration. Therefore, the EU must adopt a clear, fair, and strategic policy informed by a nuanced understanding of the legal and security dimensions.

Conclusion and Strategic Recommendations

Israel’s assault on Iranian territory flagrantly violates international law and poses a grave threat to regional and global peace and security. The ramifications extend far beyond Iran’s borders, impacting security, economic, and political spheres worldwide. In this context, it is imperative that:

  • The international community, particularly relevant global institutions, mount a firm and coordinated response upholding Iran’s rights and international order.
    – Iran strengthens its defense capabilities, leverages legal and diplomatic mechanisms, and enhances regional cooperation to safeguard its national security.
    – Neighboring countries and the European Union play proactive roles in conflict de-escalation, diplomatic facilitation, and regional stability maintenance.
    – Particular attention is given to economic consequences, especially energy market stability, to prevent broader crises.
  • Ultimately, adherence to international law, political dialogue, and multilateral cooperation remain the most viable paths toward restoring peace and stability in the Middle East and beyond.
